LoveStreaks Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Daitoku Corp. (“Daitoku,” “we,” “us,” or “our”). They govern your use of the LoveStreaks app, website, backend, support, and related services (the “Service”).

By creating an account, purchasing Premium, or using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.

If you live outside Canada, the European Economic Area, and the United Kingdom, Section 13 waives your right to a jury trial and to take part in a class action.

Nothing in these Terms limits a consumer right or remedy that applicable law does not allow us to limit.

1. Eligibility

You must be at least 13 and meet the minimum age required where you live. If you have not reached the age of legal majority, your parent or legal guardian must review and agree to these Terms for you. By using the Service, you represent that you meet these requirements.

Optional intimacy prompts are only for adults aged 18 or older. You must not enable or use them if you are under 18.

You may not use the Service if doing so is prohibited by law or if we previously terminated your account for serious or repeated violations.

2. Accounts

You must use Sign in with Apple and provide accurate, lawful information. You are responsible for protecting your Apple Account, device, and account access, except to the extent unauthorized activity is caused by our failure to meet our obligations under these Terms.

You may not sell, transfer, or share your account, operate it by automated means, or create an account for someone else. Notify support@lovestreaks.app promptly if you believe your account has been compromised.

3. The Service and shared relationships

LoveStreaks lets users create and join relationships, select or create streaks, record progress, view statistics, schedule local reminders, and use eligible free or Premium features.

Only invite people you trust and have permission to contact. Relationship members can see shared names, content, activity, and statistics. Member actions can change shared data for everyone, and another member may keep lawful screenshots or copies outside our control.

Blocking cancels pending invitations between the two accounts, prevents new invitations, and removes you from any relationship you share with that person. The remaining members keep the relationship, or a copy of its existing non-deleted history, and a group may receive a new administrator. Other members are told only that someone left, not that a block caused the departure. The current mechanics are described in the app and may change as the Service develops.

4. User Content

“User Content” includes display names, group names, custom streaks, report details, support messages, and other material you submit.

You keep any rights you hold in your User Content. You grant Daitoku a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, display, format, filter, and otherwise process that content only as reasonably necessary to:

  • operate, secure, and support the Service;
  • share it with the relationship members you selected;
  • review reports and enforce these Terms;
  • produce aggregated or de-identified statistics that do not identify you;
  • use service providers acting for those purposes; and
  • comply with law and protect legal rights.

This license ends when the content is deleted from active systems, except for limited backup, safety, and legally required copies, and except for aggregated or de-identified statistics that no longer identify you.

You represent that you have the rights and permissions needed for your User Content and that it does not violate law, another person’s rights, or these Terms. Do not put any of the following in a custom streak or other User Content: passwords, payment-card details, government identifiers, medical records, precise location, or information whose disclosure could create a serious safety risk.

Deleting your account removes custom streaks you authored and their active or inactive tracked copies. Other members may keep non-authored shared relationship history as described in the Privacy Policy.

5. Safety and prohibited conduct

You must not use the Service to:

  • harass, stalk, threaten, bully, shame, coerce, exploit, or intimidate anyone;
  • submit hate speech, graphic violence, pornography, sexual exploitation, or content that sexualizes a minor;
  • promote self-harm, dangerous activity, abuse, trafficking, terrorism, or other serious harm;
  • impersonate another person, or claim to represent Daitoku or LoveStreaks;
  • violate privacy, confidentiality, intellectual-property, or other rights;
  • disclose another person’s sensitive information without lawful permission;
  • spam invitations, scrape data, harvest friend codes, or send unsolicited promotions;
  • evade a block, suspension, content filter, rate limit, age requirement, or security control;
  • access, probe, disrupt, reverse engineer, overload, or introduce malware to the Service except where law expressly permits;
  • use bots or automated access without our written permission;
  • falsify subscription, device-integrity, identity, or streak information; or
  • engage in illegal, fraudulent, or rights-violating activity.

Intimacy prompts are for consensual adults. A streak, completion, reminder, score, or statistic is never consent and must not be used to pressure, punish, monitor, or retaliate against another person. Consent to a real-world activity can be withdrawn at any time.

6. Reports, moderation, and account action

You may report eligible content and optionally block the related account. Reports must be honest and made in good faith.

We may use automated filters and authorized human review. We may reject or remove content, reset a display name, restrict features, suspend or terminate an account, preserve necessary evidence, or contact authorities when required by law or reasonably necessary to address imminent serious harm. We may act without advance notice where notice would create risk or enable evasion.

LoveStreaks is not an emergency service and does not guarantee a response time. If someone may be in immediate danger, contact the appropriate emergency service. To appeal a moderation decision, email support@lovestreaks.app.

7. Premium subscriptions and Streak Fruit

Premium subscriptions are sold through Apple’s In-App Purchase system. The purchase screen shows the current price, billing period, and included features before purchase.

Subscriptions renew automatically unless canceled before renewal. You can manage or cancel through your Apple Account subscription settings. Apple controls billing, taxes, refunds, storefront rules, and required price-change notices or consent. We cannot issue refunds for Apple purchases; send refund requests to Apple.

Deleting your LoveStreaks account or the app does not cancel Apple billing. Use “Restore Purchases” to restore an eligible subscription. Premium requires a valid Apple transaction and may end after expiration, cancellation, refund, or revocation.

Current plan limits and features are shown in the app and may change prospectively. Changes affecting a paid subscription will be handled as required by applicable law and Apple’s rules.

Streak Fruit is an in-app feature, not property or currency. It cannot be purchased, has no cash value, and cannot be transferred, sold, or refunded. We may adjust or remove balances to correct an error or address abuse, and a balance ends when the related relationship or account ends.

8. Important Service limitations

LoveStreaks is a motivational and organizational tool. It is not medical, mental-health, legal, financial, therapeutic, sexual-health, or professional relationship advice. Built-in prompts are general suggestions, not diagnoses, treatment, or consent.

LoveStreaks is not a permanent archive or backup service. Content and data may be changed, removed, or lost through user actions, moderation, account loss, technical failure, or discontinuation. Keep lawful copies of information you are permitted to retain and consider important, while respecting other members’ privacy and rights.

We do not guarantee that reminders, invitations, reports, synchronization, streaks, statistics, features, or stored data will always be accurate, timely, available, or preserved. We do not guarantee any relationship or real-world outcome.

9. Our intellectual property and third-party services

Daitoku and its licensors own the Service, software, designs, branding, built-in prompts, graphics, and documentation. The app is licensed, not sold. You may not copy, sell, sublicense, publicly exploit, modify, or derive source code from the Service except as law or an applicable open-source license permits.

Voluntary feedback may be used by us without restriction or compensation, provided we do not identify you as its source without permission.

If you believe content on the Service infringes your copyright, email support@lovestreaks.app and we will review it and remove or restrict content where appropriate.

The Service depends on Apple and cloud providers. Their services may be unavailable or governed by separate terms. Links to third-party sites are provided for convenience; we do not control their content or practices.

For an app obtained through Apple’s App Store, Apple’s Standard EULA also governs the app license. These Terms are between you and Daitoku, not Apple. Apple does not operate LoveStreaks or provide its support, backend, privacy, moderation, or content, and has no obligation to provide maintenance or support for the app. Apple and its subsidiaries are third-party beneficiaries of this paragraph and may enforce it.

10. Disclaimers and limitation of liability

We provide the Service with the care and skill required by applicable law. Except for rights that cannot be excluded, the Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, uninterrupted availability, and data preservation.

To the maximum extent permitted by law, Daitoku and its directors, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, opportunity, goodwill, or data; personal disputes between users; or unauthorized use outside our reasonable control.

To the maximum extent permitted by law, our total liability for all claims arising from the Service during any 12-month period will not exceed the greater of:

  1. the amount you paid for LoveStreaks during the 12 months before the event giving rise to the claim; or
  2. CAD $100.

These limitations do not apply to fraud, wilful misconduct, gross negligence, non-waivable privacy or consumer rights, death or personal injury where liability cannot be excluded, or any other liability the law does not allow us to limit. They also do not excuse conduct for which applicable law makes Daitoku responsible.

11. Your responsibility and indemnity

To the extent permitted by law, you will indemnify Daitoku and its directors, officers, employees, contractors, and agents against third-party claims, and any losses, liabilities, and reasonable costs and legal fees, arising directly from your unlawful User Content, your fraud or wilful misconduct, or your material breach of Sections 4 or 5. We may take over the defence of such a claim, and you will cooperate with us.

This does not make you responsible for our negligence, our breach, or conduct that the law assigns to us, and it does not apply to the extent applicable consumer law limits it.

12. Changes, suspension, and termination

We may add, change, limit, suspend, or discontinue the Service or any feature. We do not promise that the Service, a feature, or stored data will remain available permanently. If we discontinue the Service, we will provide reasonable notice where practicable and handle subscriptions and data as required by law, Apple’s rules, and the Privacy Policy.

You may stop using the Service or delete your account at any time. We may restrict or terminate access when reasonably necessary to enforce these Terms, comply with law, address safety or security risks, prevent fraud or abuse, or discontinue the Service.

We may update these Terms for legal, security, operational, or product reasons. Material changes apply prospectively, and we will provide additional notice or request consent when required.

13. Governing law and disputes

Before filing a claim, you and Daitoku agree to try in good faith to resolve it informally for 30 days after written notice. This does not prevent urgent injunctive relief, a regulator complaint, small-claims proceedings, or meeting a legal deadline.

Except where mandatory consumer law provides otherwise, these Terms are governed by the laws of Ontario and the federal laws of Canada applicable there. The courts in Ontario have non-exclusive jurisdiction.

If you are a consumer, you retain mandatory protections and forum rights where you live.

If you live outside Canada, the European Economic Area, and the United Kingdom, you and Daitoku waive any right to a jury trial and any right to bring or join a class, collective, or representative action, to the extent the law permits. Claims must be brought individually.

To the extent the law permits, a claim arising from the Service must be started within one year after it arose. This does not shorten a period that applicable law does not allow us to shorten.

14. General

Entire agreement. These Terms, the Privacy Policy, purchase disclosures, and any feature-specific terms are the entire agreement about the Service, subject to Apple’s Standard EULA where it independently applies.

Severability and waiver. If a provision is unenforceable, the rest continues. Failure to enforce a provision is not a waiver of it.

Survival. Sections 4, 5, 7, 8, 9, 10, 11, 13, and this Section 14 survive termination of your account or these Terms.

Assignment. We may assign or transfer these Terms, in whole or in part, at any time, provided the recipient agrees to be bound by them. You may not assign or transfer your rights under these Terms.

Notices. We may give you notices about the Service and these Terms in the app, by email to the address associated with your account, including an Apple private relay address, or by posting them on lovestreaks.app.

Force majeure. Neither you nor Daitoku is responsible for a delay or failure to perform caused by an event outside its reasonable control.

Language. The parties have requested that these Terms and all related documents be drawn up in English.
